1. Who we are

This website, terrysmithagency.com, is operated by Smith Agency Of Marshall LLC, doing business as Terry Smith Agency (“we,” “us,” or “our”), an insurance agency located at 153 Columbia Ave E, Battle Creek, Michigan 49015. Terry Smith is a licensed Michigan insurance producer. We are appointed with more than one insurance company, including Farmers Insurance, and we may quote coverage through other insurers we are appointed with.

This Privacy Policy explains how we handle personal information collected through this website, our quote forms, and our related phone and text communications. Each insurance company also has its own privacy notice, which it provides when you apply for or buy a policy. That notice governs how the insurance company handles your information.

2. What we collect

Information you give us

Depending on which form you use and which coverage you ask about, we may collect:

• Contact details: first and last name, phone number, email address, and street address, city, state, and ZIP code.
• Personal details used for rating: date of birth, gender, marital status, and military or veteran status.
• Auto details: vehicle year, make, and model, drivers in the household, current insurance company, and accident, violation, and claims history.
• Home and property details: property type, ownership, characteristics of the home, and prior claims.
• Business details: business type, number of employees, and annual revenue.
• Life insurance details: tobacco use and a general self-rating of your health.
• Messages: anything you type into our contact form, including a policy number and the reason for your message.

Sensitive information. Date of birth, health and tobacco answers, and driving and claims history are sensitive. We collect them only because insurers use them to price coverage you asked about, and we use them only for that purpose. We do not ask for Social Security numbers, driver’s license numbers, or bank or card numbers on this website. Please do not enter them in a message.

Information collected automatically

When you visit the site, our hosting provider and the tools described in Cookies & website tools may automatically collect your IP address, browser and device type, pages viewed, the date and time of your visit, the page that referred you, and advertising details such as campaign (UTM) tags and ad click identifiers. We attach the campaign and click details to your quote request so we know which ad or page you came from.

3. How we use it

• To prepare, compare, and deliver the insurance quotes you request, and to help you apply for, buy, and service a policy.
• To contact you about your quote and related insurance products and services by phone, text, and email, as described in Calls & text messages.
• To check that a phone number or email address is valid and to keep spam and fraud out of our forms.
• To measure which of our ads and pages lead to quote requests, and to improve our website.
• To keep records of your consent and your contact preferences, including opt-outs.
• To meet our legal, regulatory, and insurance-company obligations.

We do not use the information you submit in our forms to train artificial intelligence models, and we do not provide it to anyone for that purpose. Your information is not used to train AI by us.

4. Who we share it with

We do not sell, rent, or trade your personal information, and we never share it with other agencies or lead buyers. We share it only in these situations:

• Insurance companies, when you ask. To quote, place, or service coverage you request, we send the needed details to the insurance company or companies we quote with on your behalf. If we use a wholesale insurance brokerage to reach an additional insurer, we share your details with that brokerage only for that purpose.
• Service providers under contract. Companies that host our website, deliver form submissions to our agency management system, verify phone numbers and emails, track calls, and run our email and text messaging. They may use your information only to provide services to us.
• Legal requirements. When required by law, subpoena, or a request from a regulator such as the Michigan Department of Insurance and Financial Services, or to protect our rights and prevent fraud.
• Sale of our agency. If our agency or its book of business is sold or transferred, your information may transfer to the new owner, subject to this policy.
• With your permission. For any other purpose you approve.

5. Calls & text messages

If you submit a quote request and agree to be contacted, we may call and text the number you gave us about your insurance quote and related insurance products and services. Some calls and texts may use automated technology. You do not have to agree to this to buy anything from us. You can call us at (269) 404-4049 instead.

• Opting out: Reply STOP, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, or OPT OUT to any text. You can also tell us on a call, by email, or by mail. Any reasonable way of telling us works. We honor opt-outs promptly, and within 10 business days at most. We may send one final text to confirm your opt-out.
• Help: Reply HELP to any text, or call (269) 404-4049.
• Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
• Mobile information is never shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent are not shared with any third party, except service providers that help us deliver messages.
• Calls may be recorded for quality and training purposes where permitted by law.

6. Do Not Call

We keep an internal Do Not Call list. If you ask us not to call or text you, we add your number to that list, honor the request across our systems, and keep it on the list for ten years unless you later give us new permission. We check marketing calls against the National Do Not Call Registry, which Michigan uses as its state list, except where you have given us your prior express written consent or have an existing relationship with us.

7. Cookies & website tools

Our website uses cookies, pixels, and similar tools provided by the companies below.

We do not intentionally send the answers you type into our quote forms to the advertising tools above, and we have turned off the Meta Pixel’s automatic button-click collection on our quote forms. You can block or delete cookies in your browser settings, and you can manage ad preferences in your Google and Meta account settings. Blocking cookies will not stop our quote forms from working.

8. Global Privacy Control & Do Not Track

We do not sell personal information. Our website does not currently respond automatically to Global Privacy Control (GPC) or “Do Not Track” browser signals. You can limit advertising measurement at any time by blocking third-party cookies in your browser, using your Google and Meta ad settings, or contacting us, and we will honor an opt-out request you send us.

9. Security

We use reasonable administrative, technical, and physical safeguards designed to protect your information, including encrypted (HTTPS) connections on this website and access limits on our systems. No website or system is perfectly secure. If a breach of your personal information occurs, we will notify you and regulators as required by Michigan law.

10. How long we keep it

We keep quote requests, consent records, and communications for as long as we need them to serve you and to meet legal, regulatory, and insurance-company recordkeeping requirements, generally at least five years. We keep Do Not Call requests for ten years. When information is no longer needed, we delete it or make it anonymous.

11. Your choices & rights

Wherever you live, you can ask us to:

• Access the personal information we hold about you;
• Correct information that is wrong;
• Delete your information, unless we must keep it by law or to service a policy;
• Stop marketing calls, texts, or emails.

Residents of some states, such as California, Colorado, Connecticut, Minnesota, Montana, Oregon, Texas, and Virginia, may have additional rights under their state privacy laws, and we will honor them where they apply. Information we collect to provide insurance services may also be governed by the federal Gramm-Leach-Bliley Act and Chapter 5 of the Michigan Insurance Code. Those laws apply to information we collect to arrange insurance for you.

How to make a request. Call (269) 404-4049 or email terry@terrysmithagency.com. We will verify your identity by matching information we already have, and we generally respond within 45 days. If we need more time, we will tell you why. You may use an authorized agent; we may ask for proof of the agent’s authority. We will not treat you differently for using your rights.

Appeals. If we deny your request, you may appeal by replying to our decision or emailing terry@terrysmithagency.com with “Privacy Appeal” in the subject line. We will respond in writing within 60 days. If you are not satisfied, you may contact your state attorney general. In Michigan, insurance-related concerns may also be directed to the Michigan Department of Insurance and Financial Services (DIFS) at 877-999-6442 or michigan.gov/difs.

12. Children

This website is meant for adults. We do not knowingly collect personal information from anyone under 18. If you believe a child has sent us information, contact us and we will delete it.

13. Other websites

Our site links to other websites, such as insurance company account portals. Those sites have their own privacy policies, and we are not responsible for their practices.

14. Changes

We may update this policy. We will post the new version here with a new effective date. If we make a material change to how we use or share information you already gave us, we will ask for your consent where the law requires it.
